Background

Ronald Foerster is a partner practising in our Toronto office. Ron was admitted to the Ontario Bar in 1987. He graduated from Osgoode Hall Law School in 1985. Prior to that, Ron received a BA from the University of Toronto.

Areas of Practice

  • Commercial Litigation including accountants liability, fraud investigation and recovery, shareholder rights, directors and officers liabilities, oppression remedy and other corporate disputes, Hospital law and general commercial disputes.
  • Constitutional and Administrative Law including Charter of Rights litigation, division of power issues and judicial review.

Professional Experience

  • Ron has appeared as counsel at all levels of court in Ontario and before the Supreme Court of Canada.
  • Commission Counsel, Arar Inquiry. Ron was appointed senior legal counsel to Justice Dennis O'Connor in the Arar Inquiry – Policy Review.
  • Commission Counsel, Walkerton Inquiry. Ron was appointed Commission Counsel to Part II of the Walkerton Inquiry between June 2000 and June 2002.
  • General Commercial Litigation including contractual disputes. Ron regularly acts for major corporations and public entities such as Hospitals on a broad range of commercial disputes, including contract issues, fraud and fraud recovery, negligence and negligent misrepresentation.
  • Accounting Profession. Ron has and continues to act for and against accounting firms in various types of litigation relating to the accounting profession including auditors' liability.
  • Shareholder rights and director and officer liability. Ron has acted for companies, directors, officers and shareholders in a broad range of intra-corporate disputes including oppression applications.
  • Constitutional Litigation including both the Charter of Rights and other areas of Constitution Law.
  • Extensive class action experience as both plaintiffs' counsel, but primarily as defence counsel.
  • Public/Administrative Law. In addition to the Walkerton Inquiry, Ron acted as one of the counsel for the Government of Ontario in the Holden (Patricia Starr) Inquiry and as counsel in litigation arising out of the Inquiry.
