About BLG’s Trade-mark Services

BLG offers both non-contentious and contentious trade-mark law services.

On the non-contentious side, BLG offers specialized trade-mark selection, searching, and protection services, and strategic domestic and international trade-mark portfolio management services. Our services include availability and registrability searches and opinions, trade-mark watch services, filing and prosecuting trade-mark applications. Our trade-mark group also drafts and negotiates license agreements, drafts and reviews transactional agreements regarding the acquisition of trade-mark and related IP rights, and represent clients in adversarial trade-mark opposition proceedings.  We are also responsible for post registration actions including summary cancellation proceedings, amendments to and maintaining and renewing trade-mark registrations.

Our expertise in non-contentious work also encompasses non-traditional and pharmaceutical marks, and strategic trade dress protection utilizing trade-mark, design and copyright regimes. Our trade-mark group excels in these areas due to our full service platform, and as a result of considerable experience. Several in our group are fully bilingual and provide advice relating to French language requirements in the Province of Québec.

In contentious matters, BLG offers specialized IP dispute and litigation services including  trade-mark infringement and passing off actions, copyright infringement and related issues.  BLG’s litigation team has represented clients before administrative boards, the provincial superior courts, all levels of the Federal Court, and the Supreme Court of Canada.

Just published! Now in its third edition, this book provides a practical overview of features of Canadian patent practice most relevant to the realms of the life sciences and chemistry, from antibodies to zwitterions. The book comprises four parts:

  • Part I outlines general patent practice in Canada.
  • Part II deals with specific subject matter areas, including chemical compounds, antibodies, and life forms.
  • Part III is devoted to regulatory issues, including the Patented Medicines (Notice of Compliance) Regulations, the Patented Medicine Prices review Board, and Subsequent Entry Biologics.
  • Part IV deals with challenges to issued patents.

Trade-mark Opposition and Litigation in BRIC and NAFTA Countries summarizes basic enforcement obligations to which each of the BRIC and NAFTA countries are obliged under the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) and the North American Free Trade Agreement.
