Executive Summary

Mark Rodger is the Toronto Regional Co-Chair of the Electricity Markets Group at Borden Ladner Gervais LLP, and a senior partner in the Toronto office. Mark is recognized as a leading lawyer in the Canadian electricity sector and has been named as one of the top 500 lawyers in Canada by Lexpert®/American Lawyer Guide.

Mark specializes in the commercial, regulatory and government relations components of electricity markets and infrastructure revitalization including considerable experience in electricity sector restructuring. For over 20 years, Mark has served as counsel to a broad range of stakeholders including municipal, provincial and national governments; large industrial, institutional and commercial energy consumers; local distribution and transmission companies;  generators; energy retailers; out-of-province electricity importers; and energy regulators.

Representative Work

  • Advises on corporate governance, business planning and utility mergers and acquisitions. Also advised on the first long-term lease involving an Ontario electricity distribution utility.
  • Counsel to numerous Ontario and out-of-province electric utilities in connection with distribution and transmission rate, leave to construct applications, and other regulatory and compliance matters, such as Market Rules and the Affiliate Relationships Code for Electricity Transmitters and Distributors..
  • Counsel to municipalities, First Nations and private sector clients regarding infrastructure renewal–electricity distribution, transmission and water services.
  • Has broad commercial and regulatory experience in renewable generation and electricity conservation and demand management, including program development and smart meter implementation initiatives.
