Executive Summary

Michael White defends product liability claims involving automotive, industrial and consumer products. Michael also defends aviation claims involving fixed and rotary wing aircraft, motor vehicle tort, municipal liability and accident benefits claims. He is a member of the Aviation Litigation and Insurance Group and the Litigation Maritime Transportation Group at Borden Ladner Gervais LLP, where he is a partner in the Toronto office.

Michael has appeared as lead counsel on jury and judge alone trials before the Ontario Superior Court of Justice and appearances in the Federal Court, Divisional Court and the Ontario Court of Appeal. Before the Ontario Financial Services Commission of Ontario, he has appeared as counsel at arbitrations involving claims for catastrophic injuries.


The legal aspects of putting a lien on cargo are discussed alongside some practical advice about when a lien may be recognized (or not) by the courts.

  • Advising and representing manufacturers, distributors and retailers in defence of their products including industrial equipment, automobiles and appliances.
  • Acting on behalf of Maritime owners in relation to issues involving maritime occupational health and safety.
  • Acting correspondent on Great Lakes vessels and representation on behalf of maritime owners, P&I clubs and freight forwarders.
  • Acting in the defence of personal injury and SABS claims.
  • Acting on behalf of Insurers in priority disputes.
  • Defending Municipalities in claims involving bodily injury, including catastrophic claims.
