Background
James Sidlofsky is a partner in our Toronto office. Mr. Sidlofsky graduated from the University of Toronto Faculty of Law in 1986, and was admitted to the Ontario Bar in 1988.
Prior to that, he majored in philosophy and received an Honours Bachelor of Arts (with Distinction) from the University of Guelph in 1983, and was awarded the University's Gold Medal in his graduating year. He was awarded a Diploma in Public Administration (with Distinction) from the University of Western Ontario in 1999.
Areas of Practice
Mr. Sidlofsky is a member of the firm's Energy Markets Group, and provides regulatory advice and representation to electricity distribution companies, electricity generators and industrial electricity customers.
Professional Experience
- Mr. Sidlofsky's activities include:
- Advising clients on regulatory matters pertaining to hydro restructuring in Ontario and participation in the Province's wholesale electricity market.
- Representation of clients, both individually and in coalitions, before the Ontario Energy Board in electricity and natural gas-related proceedings, including distribution rate applications, applications for the approval of sales of distribution utilities and gas storage facilities, leave to construct applications, and "generic" proceedings related to proposed amendments to the OEB's Transmission System Code and the Minister of Energy, Science and Technology's June, 2000 Directive regarding the objectives to be considered by the OEB in carrying out its electricity-related mandate and its ratemaking function.
- Advocacy for the amendment of Ontario Energy Board electricity-related codes and rules.
- Significant recent activities include:
- Counsel to two large industrial electricity consumers in successful applications to the Ontario Energy Board for compliance orders against Ontario's largest electricity transmitter with respect to the proper application of the OEB's Transmission Rate Order;
- Counsel to a coalition of local electricity distribution companies ("LDCs") in the OEB's Combined Proceeding on Service Area Amendments;
- Counsel to a coalition of LDCs in the OEB's Consultation on Increased Efficiency in the LDC Sector;
- Counsel to a coalition of LDCs in a successful application for the amendment of the OEB's Affiliate Relationships Code with respect to the Code's requirement for independent directors on municipally-owned LDCs' boards of directors;
- Counsel to several individual LDCs in their 2004 rate adjustment applications for recovery of the first permitted portion of their outstanding Regulatory Assets, and in the OEB's "Phase II" Regulatory Asset proceedings;
- Counsel to several LDCs in the OEB's proceeding on the development of the 2006 Electricity Distribution Rate Handbook, and in their cost of service-based applications for 2006 distribution rates; and
- Counsel to several LDCs in their 2008 and 2009 forward test year cost of service distribution rate applications.
- Prior to joining the firm in early 2000, Mr. Sidlofsky served for almost nine years as an Assistant Town Solicitor for the Corporation of the Town of Richmond Hill, one of Canada's fastest-growing municipalities, and was a member of the Town's Hydro Transition Team. His responsibilities included municipal and planning law (Official Plan, Zoning and Subdivision Hearings before the Ontario Municipal Board, review of Zoning, Licensing and other municipal By-laws and preparation of Special Legislation), and supervision or carriage of selected Building Code and Planning Act prosecutions and appeals.
