Background

Rick Williams is a partner in our Vancouver office and is the Regional Leader of the firm's Environmental, Municipal, Expropriation and Regulatory Group. He is a graduate of the University of Victoria having obtained his Bachelor of Law degree in 1999. Prior to that he received a Bachelor of Arts degree from the University of Ottawa in 1995. Rick articled with Ladner Downs (now Borden Ladner Gervais) and was admitted to the British Columbia Bar in 2000.

Areas of Practice

Rick represents and advises clients on a wide range of civil litigation and regulatory matters, with a particular focus on the areas of oil and gas, expropriation, environmental and maritime law.

Professional Experience

Rick has appeared at all levels of court in BC, the Federal Court and the Supreme Court of Canada. On regulatory matters he has represented clients before the BC Utilities Commission, the BC Surface Rights Board, the Oil and Gas Appeal Tribunal, the Alberta Energy Resources Conservation Board, and the National Energy Board.  He also frequently advises clients on their dealings with the Oil and Gas Commission.

Oil and Gas

In the oil and gas area Rick advises clients on the regulatory approval process for facilities and pipelines and on surface rights. He has represented oil and gas clients on production disputes before energy regulators, including common carrier, common processor, rateable take and shut-in applications.  Examples include:

  • Lead counsel in the first common carrier/common processor hearing before the BCUC in over 30 years, which established the test to be applied in BC.   
  • Lead counsel in the successful challenge of a public utility’s discriminatory security deposit policy before the BC Utilities Commission.
  • Acted on successful applications to the Alberta ERCB, obtaining one of the largest interim shut-ins ever. 
  • Lead counsel on many successful arbitrations/motions before the BC Surface Rights Board.

Environmental

Rick is the regional leader of the firm's environmental group and acts as counsel on a wide range of environmental disputes and prosecutions, including land development impacts, contaminated sites, migrating pollution and charges under federal and provincial legislation. His clients include oil and gas companies, developers, consultants, property managers, industry and individual landowners. Examples include:

  • Acted in a precedent setting environmental case, the first trial in BC to consider what are reasonably incurred costs of remediation under BC's legislation.
  • Represented a client on a 20 day trial resulting in its acquittal of all charges under the federal Fisheries Act.

Maritime

Rick represents and advises maritime clients on commercial disputes, cargo claims, pollution charges, bills of lading, arrests, dangerous goods, collisions, the purchase and sale of vessels and other matters. He also has experience with trucking, rail and freight forwarding disputes and issues.  Examples include:

  • Lead counsel for a foreign bank in the arrest and judicial sale of a vessel, including overseeing a rare, live courthouse auction (part of global efforts to enforce a $77M judgment from a US Court).
  • Acted for an international shipping company in successfully defending the validity of an arrest up to the Supreme Court of Canada.

General

Rick also practices general civil/commercial litigation, including contractual disputes, product liability, commercial leasing and insurance.
