David Elman is an associate in the Insurance and Tort Liability Group at the Toronto office of Borden Ladner Gervais LLP. David's civil litigation practice includes product liability, municipal and police liability, occupier's liability, insurance law, personal injury litigation and class actions,. David defends municipalities from negligence claims involving maintenance and design of roadways and sidewalks, construction projects and utilities. He defends municipal police forces from actions alleging negligent investigation, false arrest, malicious prosecution and breach of Charter rights. He advises and represents insurers in a wide range of casualty and property claims, including motor vehicle and occupiers' liability claims. He advises and represents insurers in disputes arising from life and critical illness insurance policies.
David has appeared as lead or junior counsel on motions, applications, trials and appeals before the Ontario Superior Court of Justice and the Ontario Court of Appeal. He has also represented clients in a variety of alternative dispute resolution forums such as mediation and arbitration.
