Breanna maintains a complex commercial litigation practice with a focus on commercial fraud matters. She has diverse experience in sensitive and high-stakes commercial disputes across a variety of industries and practice areas. She also has broad experience in class actions and professional liability litigation. Breanna's practice often involves investigations, injunctions, and extraordinary remedies, including Anton Piller (civil search) and Mareva (asset freezing) orders.

Breanna has appeared before all levels of court in Ontario, as well as in mediations and commercial arbitrations. She also has experience advising on legal obligations in the political sector, including in the areas of ethical compliance and conflict of interests.

Breanna is very active in the legal community, and is committed to advancing equality, diversity, and inclusion initiatives, with a focus on women in law. She is a regular Jessup moot judge, both in Canada and internationally, as well as a member of the executive of the Ontario Bar Association's Class Actions Section and Women Lawyers Forum Section. Breanna is committed to advancing access to justice and is a proud supporter of Pro Bono Ontario.

Experience

  • Prosecuted a claim for recovery of proceeds of a multi-million dollar invoicing fraud committed against an international manufacturing company.
  • Representing an individual executive in defending a $30 million claim alleging fraud and breach of fiduciary obligations, as well as a proposed worldwide Mareva injunction seeking to freeze assets: HZC Capital Inc v Lee
  • Representing a trustee in bankruptcy and successfully having alleged trusts declared to be shams and set aside: McGoey (Re)
  • Representing a global group of engineering and construction project management companies in respect of a commercial dispute initiated in Ontario: Bruce Power LP v BNT Canada LP
  • Representing a former director of a bankrupt corporation in an action for breach of duties brought by creditors standing in the shoes of the bankrupt corporation: Ridel v Goldberg (ON SCJ)Ridel v Goldberg (ONCA)
  • Representing a pharmaceutical company in a product liability class action in a successful dismissal of the matter on summary judgment prior to certification: Wise v Abbott Laboratories
