Anaïs Bussières McNicoll

Anaïs has acted in major class actions, advocating for:

• Canadian Pacific Railway Company in the class action related to the Lac Mégantic derailing incident (Ouellet v. Canadian Pacific Railway Company et al.).
• Bank of Montreal in class actions related to over-the-limit spending on credit cards (Pilon v. Banque Amex du Canada) and mortgage prepayment penalties (Haroch c. Toronto Dominion Bank).
• Aéroports de Montréal in class actions relating to aircraft noise pollution and the health hazard allegedly caused by airborne nanoparticles (Les Pollués de Montréal-Trudeau v. Aéroports de Montréal).

In addition, Anaïs has participated in a number of complex appeal cases before the Québec Court of Appeal and the Supreme Court of Canada. She has, for example, contributed to the following matters (some of them ongoing):

• Canadian Bankers’ Association, intervener before the Supreme Court of Canada in CO-Operators General Insurance Co. v. Sollio Groupe Coopératif, 2020 SCC 41, with regards to liability arising from fraudulent bank transfers.
• Conférence des juges de la Cour du Québec, intervener before the Québec Court of Appeal and appellant before the Supreme Court of Canada, in connection with the Reference re Code of Civil Procedure (Que.), 2021 SCC 27 regarding the constitutionality of Court of Québec’s jurisdiction of civil claims.
• Compagnie d’assurance-vie RBC, appellant before the Québec Court of Appeal in Compagnie d’assurance-vie RBC c. O.C., in connection with the interpretation of some clauses in a standard disability insurance contract.
• Bank of Montreal, respondent before the Québec Court of Appeal (appeal dismissed) and the Supreme Court of Canada (leave to appeal dismissed), in the Pilon v. Banque Amex du Canada action related to over-the-limit spending on credit cards.
