Zach has a multi-jurisdictional complex commercial litigation practice. He focuses on:

  • corporate commercial litigation

  • commercial arbitration

Zach has acted as counsel on matters appearing before all levels of court in Alberta and also has experience acting or assisting on matters appearing before the Provincial Court of Saskatchewan, the Court of Queen’s Bench for Saskatchewan, the Federal Court, the Federal Court of Appeal, the Supreme Court of Canada (leave to appeal) and private commercial arbitration tribunals (both domestic and international).

Zach is a member of BLG's International Trade and Arbitration Group. He also sits on the Board of Directors of a non-profit, MitoCanada Foundation, and on the Executive of the Alternative Dispute Resolution (South) subsection of the Canadian Bar Association. 

Experience

  • Co-counsel to an investment entity regarding a complex $60 million dispute regarding development of natural-gas fired power plants in an action before the Court of Queens Bench of Alberta.
  • Co-counsel to contractors in several multi-million dollar action before the Court of Queens Bench of Alberta, an investment structure for the development of natural-gas fired power plants.
  • Co-counsel to an EPC contractor in a $300 million domestic arbitration regarding the construction and operation of a carbon capture plant.
  • Co-counsel to an EPC contractor in a successful application before the Court of Queens Bench for Saskatchewan for leave to appeal a domestic arbitration award.
  • Co-counsel to a technology company in a successful defence of an application Court of Queens Bench of Alberta to set-aside an international arbitration award.
  • Co-counsel to a commercial landlord in a successful application to stay an Alberta court action in favour of arbitration.
  • Co-counsel to a claimant in an international arbitration conducted pursuant to the North American Free Trade Agreement.
  • Co-counsel to a large commercial tenant in a dispute before the Court of Queens Bench of Alberta regarding COVID-19 related store closures.
  • Co-counsel to a terminated in a dispute before the Court of Queens Bench for Saskatchewan regarding allegations of breach of confidence, breach of fiduciary duty, conversion, and conspiracy.
