This presentation will be given primarily in French with speakers responding to questions in English if the occasion arises.

The duty to accommodate and the concept of excessive constraint have caused much ink to be spilled in recent years. Employers are regularly being confronted with requests for accommodation in various contexts, whether they be requests made due to religious convictions or a handicap (including drug or alcohol dependency), or because of an employee’s gender identity, amongst others.

Over and above the messages conveyed by the media on this subject, it seems proper to ask what are the actual limitations of employers’ obligations in this matter.

Our presenters, Marie-Pier Emery and Catherine Pronovost, will walk you through some general principles applicable in this regard, providing practical advice to enable you to deal with these requests in a structured fashion. In addition, using examples drawn from case law, they will discuss some of the pitfalls to be avoided in such situations.
