The Employee’s Obligation to Act Faithfully: A Wider Duty than Non-Competition and Non-Solicitation Clauses Impose

Article 2088 of the Civil Code of Québec obliges employees to act faithfully and honestly and to refrain from using any confidential information they obtain in the performance or in the course of their work. How can this obligation assist employers in the absence of any non-competition and non-solicitation clause, or where such clause is adjudged to be abusive?

At this breakfast seminar, Patrick and Rose will provide an overview of the case law dealing with the duty of loyalty during and at the end of the employment relationship, as well as with the legal recourses available to employers. In particular, the speakers will discuss the challenges faced by employers in proving a breach of this duty of loyalty.
