Cory has extensive experience in a variety of areas, including commercial litigation, insurance and tort litigation, estate litigation, professional negligence, product liability, class actions, construction, and oil and gas disputes. Cory is a seasoned lawyer with more than 17 years of experience providing advice and representing local, national and international clients on a wide range of legal disputes, both inside and outside of the courtroom.

Cory’s estate litigation practice encompasses disputes involving wills and their interpretation, passing of accounts, removals of trustees, powers of attorney, beneficiaries rights, and inter vivos gifts. He also has experience in insurance defence, including advising and representing parties on various lawsuits involving claims of serious personal injury, professional negligence, product liability, wrongful termination, oil and gas litigation, construction losses, class actions and property losses. 

Cory has extensive trial and courtroom experience, having appeared at all levels of court including the provincial court, Court of Queen’s Bench, and the Court of Appeal, in both New Brunswick and Alberta. He has also successfully opposed leave applications to the Supreme Court of Canada through written argument. Cory’s experience in resolving dispute on behalf of his clients, has led to extensive and invaluable experience in conducting hundreds of discoveries, arguing contested applications, running month long trials with numerous experts involved, and resolving numerous claims through alternative dispute resolution processes, whether mediation or through the Judicial Dispute Resolution process. Cory’s most recent trial experience was in 2018 and 2020, where he was the lead counsel on two 4 week trials (as well successfully opposing a resulting appeal to the Court of Appeal), involving claims of serious injury and allegations of ongoing chronic pain. In both cases, Cory and his team successfully defended BLG’s clients’ interests in obtaining judgments of far less than demanded by the Plaintiffs and their counsel. Trial experience aside, inherent in Cory’s practice is a practical and reasonable approach to a fair, efficient and cost effective handling of legal claims, in achieving excellent results for his clients.

Experience

  • Condominium Corporation No. 0712898 v. Carlisle Inc. et al. (Unreported): Involved a claim for extensive damages in a construction loss to a large condominium building in Calgary. In March 2022, Cory and his team from BLG were successful in obtaining Summary Dismissal of the Plaintiff’s Claim.
  • Mason v Thompson, 2020 ABQB 76: The Plaintiff sought damages in excess of $2 Million in a lawsuit where the Plaintiff suffered serious personal injuries including ongoing chronic pain which eventually resulted in surgery, as well as serious and debilitating psychological issues.
  • Petz v. Duguay 2018 ABCA 402 (Leave to Appeal to the SCC denied): The Plaintiff sought damages in excess of $1 Million as a result of complaints of ongoing chronic pain, somatic symptom disorder, depression suffered in a motor vehicle accident. Cory on behalf of the insurer for the Defendant, was successful in defending the Plaintiff’s claims. BLG were successful in defending the Plaintiff’s appeals to both the Alberta Court of Appeal, and also having the Plaintiff’s application for leave to the Supreme Court of Canada dismissed with costs.
  • Youn v. 1427062 Alberta Ltd. (Red’s Pub) 2016 ABQB 606 (upheld on appeal 2018 ABQB 241): The Plaintiff sought damages of $1.7 Million as a as a result of property damage and business losses sustained due to a fire. Cory successfully brought a summary dismissal application as against the Plaintiffs, and met the stringent onus associated with summary dismissals.
  • Paragon v. Morgan 2014 ABCA 363 (leave to appeal to the Supreme Court of Canada denied): Paragon sought to set aside a fraudulent conveyance of a $1 Million home from mother to her two daughter’s. Cory and BLG were retained to appeal the lower Court’s decision, dismissing the Plaintiff’s claim.
  • Obtained judgment for client in excess of $450,000, in relation to a breach of contract and also successfully defended a counterclaim involving claims of breach of fiduciary duties, following a two week trial.
  • Successfully represented a client in a week-long injunctive relief hearing that involved allegations of breach of fiduciary duties and unfair competition.
  • Successfully represented a client in an appeal from a regulatory fishing offence that centred on the issues of a collateral attack and res judicata.
  • Successfully represented a client in a trial involving claims of professional negligence; the plaintiff claimed that both the hospital and doctor had failed to meet their standard of care in a wrongful birth claim.
  • Successfully represented a client in a trial claiming professional negligence and negligent misrepresentation in a property dispute.
  • Secured judgment and payment for a client in relation to a mortgage that secured funds in excess of $6 million.
  • Successfully represented a client in a dispute over the distribution of the proceeds of the sale of property arising out of a fraudulent lending scheme in a large class action lawsuit.
  • Successfully represented a client in a dispute regarding the amount owing by various guarantors to a lender after judgment had been obtained against them.
