Andrew is an experienced advocate who practices in all areas of commercial litigation, including:

  • energy disputes, including contractual, royalty, operator and other energy-related disputes;
  • contractual disputes, including misuse of confidential information, alleged breaches of trust and/or fiduciary duty, negligence claims; and intentional torts
  • shareholder disputes; and
  • commercial arbitration.

Andrew also maintains a labour and employment practice. He routinely acts for employers on wrongful termination cases, breaches of restrictive covenants, human rights complaints and workers’ compensation matters. He also regularly advises on occupational health and safety matters, and has been involved in a number of occupational health and safety investigations and prosecutions.

Andrew has appeared as lead counsel before the Alberta Court of King’s Bench, the Alberta Court of Appeal, and various other administrative tribunals and in commercial arbitrations. Andrew has also appeared before the Courts in British Columbia, Manitoba and Saskatchewan.

Andrew provides legal services through a Law Corporation.

 

Experience

  • Ruel v Rebonne, 2022 ABQB 271 – successful at trial in enforcing a non-competition covenant against a vendor of a business, which included an award for breach of contract and aggravated damages. 
  • Successfully obtained an injunction for a company against a former employee related to breaches of restrictive covenants.
  • Successfully obtained an injunction for a company against a former employee preventing the employee from making defamatory comments about the company to its investors.
  • Kuzoff v Talisman Peru BV Sucursal del Peru, 2020 ABQB 424 – successful in seeking double costs following dismissal of a claim for breach of contract and wrongful dismissal.
  • Kuzoff v Talisman Peru BV Sucursal del Peru, 2020 ABQB 111 – successful dismissal of an appeal of a claim for breach of contract and wrongful dismissal.
  • Corbett v River Spirit Development Co Limited Partnership, 2018 ABQB 19 – successful in seeking a declaration that the terms of a partnership agreement could not be modified.
  • Inayat v Vancouver Career College (Burnaby) Inc. (Eminata Group), 2017 ABPC 124 – successful in a dismissal of an employee’s claim for wrongful dismissal.
  • Stangenberg v Bellamy Software, 2016 ABQB 160 – successful in opposing an application for summary judgment for wrongful dismissal.
  • SterlingCapitalBrokers Ltd. acquired all of the issued and outstanding shares of Riverview Insurance Solutions Inc.
