Simon advises construction industry players both “upstream,” for example, concerning governance and integrity programs, and “downstream.” He is a Fellow of the Chartered Institute of Arbitrators (FCIArb) and has acted as both a pleader and an arbitrator

Specializing in complex litigation, Simon has handled a large number of important cases, before both courts and arbitration tribunals. He has pleaded a number of landmark cases in the field of construction law in recent years. 

Simon has published numerous articles and given many presentations in Canada, the United States and other countries in the Americas and Europe, on subjects related to the fields of litigation and construction, and he serves regularly as a trainer in workshops for younger lawyers on the art and techniques of trial advocacy.

  • Achieving (for contractors, owners, engineers and equipment manufacturers) negotiated and favourable settlements of a number of major claims in the fields of civil engineering (site preparation, highways, bridges, hydroelectric works), industrial projects (mines, petrochemical plants, sawmills), building projects (hospitals, stadiums, office buildings, etc.), and engineering services
  • Inter-Cité Construction Ltée v. Procureur Général du Québec (MTQ): obtained a judgment awarding over a million dollars of compensation to a contractor that had not been awarded a contract owing to a reservation clause, in order to cover the costs incurred by the contractor for the resources assigned to the project in vain (management staff and machinery) during the period preceding the sending of the notice of cancellation of the project
  • Constructions du St-Laurent v. Aluminerie Alouette: obtaining, for the contractor responsible for the site preparation work, a judgment awarding compensation to cover its additional costs resulting from changes to the contract and to soil conditions different from those anticipated
