Legal Privilege for In-House Counsel Seminar

June 07, 2018

7:30 a.m. - 9:00 a.m.

Borden Ladner Gervais LLP
1900, 520 3rd Ave SW Calgary, AB, Canada T2P 0R3

Identifying privilege for business communications can be a complex area. Are internal emails protected by solicitor client privilege because in-house counsel was copied on them? Does marking a letter “without prejudice” mean that its contents can never be disclosed in subsequent litigation? Does the fact that an internal investigation was conducted at the instruction of counsel mean that all investigative materials are cloaked in privilege?

This session will deliver insights and guidance to help general counsel and their in-house teams best ensure that internal communications are protected by the various types of privilege.

Session will include:

  • A practical overview of the varieties of privilege for in-house teams including how best to utilize:
    • Solicitor client privilege
    • Litigation privilege
    • Common interest privilege
    • Settlement privilege
  • An update on current issues, including recent cases
