In this session, we’ll focus on the intersection between privacy and competition law in Canada and the US. We’ll begin by outlining the ongoing normative debate in Canada, the US and elsewhere regarding the appropriate role (if any) of competition law in addressing various (alleged) harms, including privacy harms, arising from or related to Big Data and, more particularly, to the collection, storage and use by online platforms and other firms of data from and about consumers.

Next, we’ll describe the positions taken by the Canadian and US competition authorities on that question. Finally, we’ll look at the enforcement approaches taken by the Canadian Competition Bureau and US Federal Trade Commission in specific areas where privacy concerns may arise, including misleading advertising and mergers.
