Québec adopts Bill 64 – Key requirements for businesses

On Sept. 21, 2021, the Québec National Assembly adopted Bill 64, An Act to modernize legislative provisions as regards the protection of personal information, which brings significant changes to Québec private sector and public sector privacy law.

This article focuses on proposed amendments to Québec’s Act respecting the protection of personal information in the private sector (Private Sector Act) and summarizes the key impact of Bill 64 for businesses in two sections. In Section 1, we present the main new requirements introduced to the Private Sector Act, in order according to the date they come into force. It should be noted that this implementation period begins on September 22, 2021 which is the date of assent of the Act to modernize legislative provisions as regards the protection of personal information. In Section 2, we provide a summary of the new enforcement mechanisms for ensuring compliance with the Act.
