Brendan is the Regional Group Manager of Disputes (Commercial and Construction) within the Toronto office. He is a commercial litigator with extensive experience with anti-fraud litigation, shareholder and partnership disputes, injunctions, and banking litigation (including insolvency litigation). Brendan also acts on cross-border disputes, including the recovery of assets, and the recognition and enforcement of foreign orders.

He has appeared before all levels of court in Ontario and the Federal Court of Canada, along with senior commercial arbitrators.

He is fluent in English and conversational in French.

Brendan provides legal services through a Law Corporation.

Experience

  • Acts for major insurers in a wide variety of disputes relating to individual and organized benefits fraud.
  • Has acted for major financial institutions and corporations in obtaining urgent injunctive relief, including: (i) Anton Piller Orders to search for and secure evidence relating to domestic and international frauds, and the theft of intellectual property, (ii) Norwich Orders to obtain financial and other records without notice to the account holder, and (iii) Mareva Injunctions to freeze bank accounts and other assets.
  • Has acted for major manufacturers in the urgent and time sensitive recovery of industrial equipment unlawfully seized by third parties.
  • Acts for shareholders and partners in corporate disputes, including litigation and arbitration in oppression remedy proceedings.
  • Acts for developers and landlords in a variety of real estate disputes, including claims to proprietary interests and in relation to leases.
  • Acts for major financial institutions and other creditors in the enforcement of security, insolvency and contractual disputes. This includes litigation regarding private and court-appointment receivers, and reorganizations and disputes under the Bankruptcy and Insolvency Act and the Companies' Creditors Arrangement Act.
  • Acts for U.S. and other international companies in enforcing foreign judgments and orders in Ontario. This includes the enforcement in Ontario of letters of request from foreign courts, as well as representation in Canadian insolvency proceedings and litigation.
  • Acts on disputes relating to a commercial mortgages in Barbados.
  • Represents parties in a number of significant competition law matters, including misleading advertising, price-fixing, and abuse of dominance cases.
  • Acted for a U.S. coal supplier in obtaining access to $33 million of its product.
