Martin advises clients on transport, insurance, product liability, regulatory, and corporate commercial disputes. Martin is also the National Leader of the Latin America focus group and routinely assists companies with international contractual and jurisdictional disputes, international distribution and logistics agreements, and commercial aspects of trade.

Martin’s transport law practice includes litigation, regulatory, risk management, and transactional advice specific to transportation services contracts and transportation mergers and acquisitions (including Transport Canada and Canadian Transportation Agency consents and approvals on air operator changes of control, licenses and charter permits, and Canadian ownership determinations for air transportation services).

Martin’s products practice specifically comprises product liability, product regulation (including hazardous products labelling), vehicle safety recalls, and emerging technologies in transportation (such as autonomous vehicle technology). His corporate commercial disputes practice includes distribution, logistics, charter-party, licensing, international sales, as well as share purchase and asset purchase disputes.

Martin has successfully represented clients at various levels of the Ontario Courts and the Federal Court of Canada, including the Federal Court of Appeal. He represents clients before various administrative tribunals, regulatory bodies, and in complex commercial arbitration proceedings in several specialty litigation areas.

Martin holds advanced degrees in Economics and Business Administration (MA and MBA designations) and has benefited from an international upbringing that enables him to work and communicate in several foreign languages, including Spanish, German, Portuguese, and French, in further support of the international reach of his practice.

Experience - Specialty Litigation

  • Represents international clients in proceedings involving jurisdictional disputes and international commercial agreements.
  • Represents OEMs in respect of Notices of Defect/ Recalls and ship owners in respect of regulatory/quasi-criminal investigations, MARPOL-related investigations, and inspections pursuant to the Canada Shipping Act and other statutes.
  • Successfully represented clients in commercial arbitration proceedings relating to charter-party and corporate-commercial disputes.
  • Successfully defended clients in multitude of proceedings involving regulatory and quasi-criminal charges in connection with transport-related statutes and regulations.
  • Successfully represented vessel operator before the Federal Court of Appeal on Marine Liability Act limitation of liability action within the context of a personal injury pleasure craft incident.

Experience - Transactional & Regulatory Work

  • Acted and advised vendor in non-scheduled Canadian air carrier acquisition.
  • Acted and advised buyer in cross-border asset purchase involving commercial truck body manufacturer in Canada.
  • Acted and advised foreign manufacturer of cranes and commercial motor vehicles in respect of Canadian distribution and Transport Canada compliance.
  • Regularly act for Canadian and foreign OEMs in respect of Transport Canada regulatory compliance and filings.
  • Represents major Canadian and international companies on transport regulations, including Canadian market entry projects, transport competition law, mergers and acquisitions involving transportation undertakings, carrier safety profile management, and development of commercial motor vehicle compliance, licensing and registration programs across Canadian jurisdictions.
  • Represents and advises major OEMs and distributors on Transport Canada regulations, rights and obligations under the Motor Vehicle Safety Act regulations (including issuance of Notices of Defect and recalls), homologation and certification standards, emerging technologies and negotiations with regulators.
  • Represents and advises major North American and international supply chain management, transport, and freight-forwarding companies on establishing cross-border brokerage operations (regulatory facets) as well as valuation, transfer pricing, trade compliance verification notification and vessel-specific tariff classification.
  • Advises transport industry interest groups on NAFTA modernization and its implications.
