Bevan Brooksbank



Bevan maintains a broad commercial litigation practice, including the defence of class actions proceedings. He has particular expertise in the Canadian automotive sector. In addition, he also advises clients on shareholder and contractual disputes, oppression remedy litigation and franchise disputes.

Bevan acts for companies, receivers and court officers with respect to insolvency litigation on the Commercial List. He also possesses broad experience with respect to injunctive relief, such as interlocutory injunctions, Mareva and Anton Piller Orders. He has appeared before all levels of courts in Ontario, and acts on commercial arbitrations.

From 2014-15, Bevan was seconded to Volkswagen Group Canada. He reported to the general counsel and advised on product liability, dealer advisory and commercial matters.


  • Acting for Ernst & Young Inc. in its capacity as monitor in the CCAA proceedings of PharmHouse Inc. a cannabis producing company.
  • Acts for and advises Canadian automobile manufacturers with respect to risk management and arbitrations brought nationally under the National Automobile Dealer Arbitration Program ("NADAP"). He has worked with Volkswagen, Audi, Porsche, Lamborghini, Fiat Chrysler, Toyota, Hyundai and Kia brands.
  • Successfully acted for an automotive manufacturer in setting aside an arbitral award on the basis of jurisdiction (FCA Canada Inc. v. Pajunen, 2017 ONSC 7223).
  • Acted for automobile manufacturers in defending and settling national class proceedings, and in responding to inquiries from the Competition Bureau.
